1 . Validity of the AGB

1.1 These General Terms and Conditions of Business apply to contracts for the rental of holiday flats for lodging purposes and to all other services.
1.2 The subletting or further letting of the holiday home provided and its use for purposes other than residential purposes require the prior written consent of Ziel Immobilien.

 

2. booking request and reservation

2.1 Booking requests can be made directly in our office, via our homepage, by phone or e-mail. An offer will be sent to the guest in writing and this will be kept for 7 days.

2.2 A booking request is not a binding reservation or booking. The booking is only binding once an advance payment has been made and a confirmation has been received from Ziel Immobilien. Upon payment, the Guest expresses his/her agreement to these General Terms and Conditions.

2.3 After payment in advance, Ziel Immobilien is obliged to keep the flat booked by the Guest ready and to provide the agreed services.

 

3. conclusion of contract

3.1 .     At the time of the receipt of the down payment the contract is considered legally effective.

3.2 The stated rental prices include electricity, water, waste disposal, W-Lan access, cleaning service every 14 days and final cleaning.

3.3 The guest is obligated to immediately check the booking confirmation received for correctness and to inform Ziel Immobilien about any inaccuracies. The notification of discrepancies must be made within 5 working days. Any incorrectness or discrepancy reported late does not entitle the guest to withdraw from the contract.

3.4 The Guest must send a written confirmation of the booking confirmation, either by post in the form of the signed confirmation or by email in response to the confirmation sent by Ziel Immobilien.

3.5 The rental contract is only valid for the period of time, number of persons and possibly pets mentioned in the contract. If necessary, additional persons can be registered before arrival, whereby the rental price will be adjusted according to the actual number of persons.

3.6 Once the contract has been concluded, withdrawal from the contract is only possible in accordance with the cancellation conditions. There is no legal right of withdrawal.

4. payment processing, withdrawal, deposit

4.1. a) Payment. After receipt of the offer a deposit of 20% of the total price is due. If this deposit is not received by Ziel Immobilien within 7 days, the offer expires.

4.1. b) Balance. The balance is due 30 days before arrival. Late payments or non-payments are considered as withdrawal and entitle Ziel Immobilien to rent out the property to another party and to charge a fee in accordance with the withdrawal regulations.

4.2. cancellation. The following deadlines and cancellation fees apply in the event of cancellation of the booking:

- Up to 6 weeks (42 days) before arrival the deposit will be refunded

- Between 6 and 4 weeks (28 days) before arrival 20% of the total amount

- Between 28 and 0 days before arrival or in case of no show 100% of the total amount

4.3. a) Cancellation of travel. In the event of cancellation, the Guest is entitled, in accordance with the booking confirmation, to provide one or more replacement participants who will enter into the contract concluded with you with all rights and obligations. Ziel Immobilien may object to the person(s) of the substitute participant(s) if the substitute participant(s) does not meet the special requirements of the execution of the contract or if his or her entry into the contract is contrary to statutory or official regulations. If flights are cancelled due to the pandemic of COVID-19, without compensation or entry to Tenerife is forbidden, the landlord has the possibility to offer the conversion of the paid deposit or payment, but is not obliged to do so. The cancellation conditions mentioned in point 4.2 continue to apply. Refunds and conversions must be expressly confirmed in writing by the Lessor. Other claims, additional costs and refunds cannot be asserted.

4.3. b) The conclusion of travel cancellation insurance is expressly recommended.

4.4 Reimbursement. Ziel Immobilien is entitled to withdraw from the agreement for objectively justifiable reasons, for example if force majeure or other circumstances beyond the control of Ziel Immobilien make the fulfilment of the agreement impossible. In this case, 100% of the payment made will be refunded. ZI is not obliged to provide equivalent alternative accommodation.

4.5 Deposit. A security deposit of €200.00 will be paid 7 days prior to arrival separately from other payments with the description "Fianza" (in English "deposit") by bank transfer. The deposit will be refunded 7 days after departure by bank transfer, provided there are no damages. The deposit is only used to cover damages, it is not used to pay the rent or possible additional services.

5. liability

5.1 Any liability for temporary disruptions in the water or electricity supply or disruptions due to natural or local events is excluded.

5.2 The use of the Apartment including all associated outdoor facilities shall always and exclusively be at the sole responsibility of the Tenant. Ziel Immobilien shall at no time be held liable for any damage, including physical damage, caused by accidents in the rented flat or on its property on the guest's side. Exceptions are only made in case of gross negligence or intent.

5.3 The tenant is liable for wilful and negligent damage to the flat, the furniture, the building and the inventory. This shall also apply if the damage was caused by the Tenant's guests

5.4 The legal guardians are responsible for the supervision of children travelling with them.

5.5 The Guest is responsible for his or her own property and valuables as well as cash brought along. Destination Immobilien assumes no liability for damage or loss. We recommend taking out appropriate travel insurance for such cases, although the flats have a safe.

5.6 Guest's claims expire after six months, unless Ziel Immobilien is liable for intent.

6. duties of the tenant

6.1 In the event of defects occurring, complaints must be reported immediately and within 24 hours of their occurrence to Ziel Immobilien or the local administrator, only then can claims for reimbursement after the end of the holiday be considered.

6.2 Ziel Immobilien must always have the opportunity to rectify the defects within a reasonable period of time. Guests who fail to comply with the obligation to report and leave the accommodation without the express consent of Ziel Immobilien lose all entitlement to a possible refund of the rental price.

6.3 The flat is to be left clean, i.e. broom and cupboard clean. In case of excessive or wilful soiling of the flat by the Guest, Ziel Immobilien is entitled to charge additional cleaning costs.


7. arrival and departure, handing over the keys; late eviction

7.1 The flat is available on the day of arrival from 16.00 hrs. An arrival before 16.00 o'clock can only take place if this has been expressly agreed in advance with the destination real estate.

7.2 The Guest is obliged to present his/her valid identity card or passport to Destination Immobilien at the latest upon arrival.

7.3 On the day of departure, the Guest must vacate the flat by 10.00 a.m. at the latest. A departure after 10.00 a.m. can only take place if this has been expressly agreed with Destination Immobilien in advance.

7.4 The evacuation is only considered to have been effected when all keys have been handed over to the owner or manager. In the event of early departure, the keys can be left in the Casa Colores letterbox at the garden gate, provided this has been agreed in advance with Ziel Immobilien. The guest is obliged to check that the flat door is properly locked.

7.5 If one or more keys are lost, the Guest must pay compensation to Ziel Immobilien for their replacement and, if necessary, for the installation of new locks.


8. house rules:

8.1 The current house rules are to be observed, which will be made available to the guest in writing upon arrival and are displayed in every flat.

8.2 In particular, the regulations concerning the night's rest between 10.00 p.m. and 10.00 a.m. must be strictly observed.

8.3 It is forbidden to accommodate more people than the number of beds provided.

8.4 Smoking is only allowed on the terraces and balconies.

8.5 The prior consent of the Destination Properties is required for bringing pets for an additional charge. The guest is liable for any damage caused by the animal.

8.6 If furnishings are missing, please contact us immediately. An inventory list is available in each flat.

8.7 The W-Lan is provided free of charge. Ziel Immobilien is not liable for possible breakdowns.

8.8. the use of the internet is permitted, as long as it does not violate the legal regulations. Criminal acts (especially illegal downloads, page views) will be reported and prosecuted. The guest alone is liable for illegal use of the Internet.

8.9 The hand and bath towels may not be taken to the beach.


9. data protection

9.1 The personal data provided by the guest will not be passed on to third parties by Ziel Immobilien, unless this is necessary for the execution of the contract.

9.2 Ziel Immobilien is obligated to submit a registration form correctly filled out and signed by the Guest to the responsible authorities.
